Rights and Obligations of Members of the ALBGC
Terms and Conditions of Membership in the Albatross Golf Club Praha (hereinafter only referred to as the “ALBGC”)
I. Establishment of Membership
1. Any natural person or legal entity who fulfils the following Terms and Conditions can become a member of the ALBGC:
2. The Board of Management of the ALBGC notifies the applicant in writing of the approval of the application within 14 days of the date of the submission of the application. The Board of management of the ALBGC has the right to reject an applicant’s application without stating a reason. The ALBGC’s Board of Management is to notify the applicant of such a rejection within 14 days of the date on which the application was submitted.
3. If the Board of Management notifies the applicant that their application has been approved, the applicant is obliged within 14 days of receiving this notification to pay the fee for joining the club according to the given type of membership and the annual club subscription. If the applicant duly pays these charges within the stipulated deadline, they become a regular member as of the day the aforementioned fee and subscription are credited to the ALBGC’s account. A new regular member receives a membership certificate from the ALBGC within 14 days of the date on which their membership is established. In the event that the fee and subscription are not paid within the stipulated deadline, the approved application loses its validity as of the first day following the lapse to no effect of the 14 days for the payment of the amount of the aforementioned charges.
4. In the event that the ALBGC is a member of the Czech Golf Federation (hereinafter only referred to as the CGF), the ALBGC will register the member with the CGF upon the payment of the annual club subscription and the member has the right to a CGF player’s card. The fulfilment of other possible conditions stipulated by the CGF is a prerequisite for this.
5. A member conditionally accepted for a year only has the opportunity to deliver a written apply for a transformation of his membership to a membership of a physical person throughout the last month of his yearly membership. A written decision about this transformation will be delivered to the applicant from the Board of Management of ALBGC within 14 days from the day the application was delivered at the latest. ALBGC’s Board of Management is authorized to dismiss the application without giving a reason. Such decision will be sent by the LABGC’s Board of Management to the applicant within 14 days from the date when application was delivered. If the ALBGC’s Board of Members informs an applicant about a successful transformation, his/her duty is to pay the entering club fee and the yearly fee within the next 14 days. The yearly club fee which was paid with the conditional admission is subtracted from these fees. If the applicant properly pays all his fees in the set time limit, he/she becomes a regular member the very same day when money is put to the club’s account. A membership certificate will be delivered to the new regular member within the next 14 days from the day when he/she became a member. In case the fees are not paid during the set time limit, the agreed application become ineffective the very first day after those 14 days appointed for the payment of the above described fees.
II. Rights and Obligations of Members of the ALBGC

A. Regular Membership A natural person or legal entity may become a regular member of the ALBGC and regular membership can take the following forms:
1. Membership of a Natural Person (hereinafter only referred to as “MNP”) This membership is intended for a natural person who is over 18 years of age. It is transferable with the prior consent of the Board of Management.
2. Household membership (another family member) This is a non-transferable membership intended for a spouse or partner who lives in a common household with someone who holds MNP or the son/daughter of this person. Household membership entitles and binds the member to the same rights and obligations held by the MNP holder, from whom the specific Household membership is derived. A condition for obtaining Household membership is the written consent of the MNP holder to whom household membership pertains. Furthermore, the applicant must submit a statutory declaration on the fulfilment of the conditions for cohabitation in a common household with the MNP holder. In the event of a transfer of MNP to which Household membership applies or upon the dissolution of the marriage or the end of cohabitation in a common household with the person who holds MNP in the ALBGC, the holder of Household membership has the right to transform their membership to MNP under the same conditions as though they obtained such membership when they became a holder of Household membership.
3. Family membership Family membership includes membership for two adults and as many as two children up to 15 years of age. All persons joining the club on the basis of Family membership must enrol in the club at the same time. Family membership cannot be claimed upon children being enrolled subsequently.
Family membership consists of:
4. Yearly membership This membership consists of annual non-transferable membership in the club. It entitles the holder to the same rights and obligations held by a holder of MNP. In the event that a member decides after one year of being a member to change their yearly membership to MNP, the price paid for preliminary annual membership is deducted from the current joining fee for MNP.
5. Children’s membership and Junior membership These memberships are intended for children up to 15 years of age and juniors up to 18 years of age. They end upon the person reaching the stipulated age limits. These memberships entitle holders to use all club facilities. Someone who holds this form of membership cannot be elected to the ALBGC’s executive bodies. Children’s membership is intended for children aged up to 15 years and it must be requested by their statutory guardian. Junior membership is intended for juniors for the period between the age of 15 and 18 years of age and it must be requested by their statutory guardian.
An applicant for this time-restricted membership is accepted for a determinate period up to the end of the calendar year that precedes the year in which the applicant reaches 15 and/or 18 years of age. Before the validity of Children’s membership ends, the statutory representative of such a member may ask the ALBGC’s Board of Management for the holder of Children’s membership to be reassigned to the Junior membership category. If the ALBGC’s Board of Management approves such a reclassification, the member (applicant) is obliged to pay a sum equal to the difference between the amount of the joining fee applicable for the new category of membership at the time when they first joined the club and the amount of this joining fee that was originally paid. Before Junior membership ends, the holder of such membership may ask the ALBGC’s Board of Management to be reassigned to MNP. If the ALBGC’s Board of Management approves such a reclassification, the member (applicant) is obliged to pay a sum equal to the difference between the amount of the joining fee applicable for the new category of membership at the time when they first joined the club and the amount of this joining fee that was originally paid. On the basis of a decision by the ALBGC’s Board of Management, membership applicants may have the amount of their joining fee for individual forms of membership reduced in cases where a) the member represents the club on a club team, b) the member achieves a handicap of less than 4 (this applies for Children’s Membership), c) they become club champion.
Membership of at least three years is a basic condition for a decision by the Board of Management on reducing the membership fee.
6. Senior membership This membership is intended for natural persons older than 65 years of age. It is non-transferable.
7. Corporate membership This membership is non-transferable. It applies to firms (both natural persons and legal entities) and it is provided according to the number of memberships obtained. It entitles holders of this membership to use all club facilities. The firm is obliged to provide a list of names of corporate members of the ALBGC by the end of March each year. Other terms and conditions of corporate membership are the subject of individual negotiations between the ALBGC and parties interested in this membership. The Board of Management may specify other types and forms of membership and the rights and obligations that pertain to them. Club joining fees, annual subscriptions and other subscriptions apply to all forms of membership, and these are set by the Board of Management. The Board of Management may give preferential treatment to club members according to their performance levels, age or other criteria. The amount and types of subscriptions are set by the Board of Management for each calendar year. On the basis of a decision by the Board of Management, the amount of the joining fee for individual forms of membership may be reduced for membership applicants in the event that they perform commendable activity for the development of the ALBGC, if they support the activity of the ALBGC in an important way, or in other exceptional cases.
B. Honorary Membership In granting honorary membership, the ALBGC’s Board of Management is not obliged to state the reasons for such a decision.
1. Honorary membership – Platinum A platinum honorary member has the same rights and obligations as a regular member, but is exempt from paying joining fees and annual subscriptions for the ALBGC. Platinum honorary membership is for life and is non-transferable.
2. Honorary membership – Gold A gold honorary member has the same rights and obligations as a regular member, but is exempt from paying the joining fees for the ALBGC. Gold honorary membership is for life and is non-transferable.
C. Transfer of MNP MNP is transferable between persons upon the prior consent of the Board of Management. A transfer of MNP is possible for a person fulfilling the preconditions for the establishment of MNP. A proposal for the transfer of MNP is submitted in writing by the transferor to the Board of Management. The proposal must contain information on the recipient, their consent to acquiring membership, and the reasons for the transfer to such an extent that it is possible to assess the grounds for the transfer of the membership in the ALBGC and the suitability of the recipient of the membership. The Board of Management notifies the transferor and recipient in writing of its decision on the transfer of membership. This decision does not require any justification.
MNP for which all obligations to the ALBGC have not been settled is non-transferable.
A person to whom membership is transferred does not pay any joining fee for acceptance into the ALBGC. A condition for initiating Board of Management proceedings on the transfer of membership is the obligation of the transferring member to pay the ALBGC an administration fee for the transfer of membership. The level of administration fees amounts to 20% of the value of the joining fee for regular membership applicable for the year in which the transfer of membership should take place. Upon a transfer of membership to a relative in a direct line of descent, the administration fee amounts to 1000 CZK. The Board of Management returns a paid administration fee to the applicant in the event that it rejects the transfer of membership.
Membership in the ALBGC terminates:
Termination of membership is understood to mean the deletion of the member from the ALBGC’s register and simultaneously from the relevant register kept at the CGF. This constitution was approved by a preparatory committee on 12 November 2008. |
